DUPONT CIRCLE ADVISORY NEIGHBORHOOD COMMISSION NOVEMBER MEETING SUMMARY

Happy Thanksgiving!

Below is a summary of the actions taken by the Dupont Circle Advisory Neighborhood Commission (Commission or ANC 2B) at the November 12, 2003, Regular Meeting.  Please note that this summary does not constitute an official record of the meetings. Contact the Executive Director or appropriate Commissioner for additional information.

PUBLIC ANNOUNCEMENTS

-- It was announced that that the Department of Public Works will next conduct Leaf Collection in the Dupont Circle neighborhood from December 15-19, 2003.  Leaves should be raked and placed with out with your trash by December 14th.

-- It was announced that the Commission was continuing its response to an audit conducted in 2002.

PUBLIC SAFETY ISSUES

-- It was announced that Judge Susan R. Winfield had suspended an 18 year sentence for the well-known "Second-Story Burglar," Gregory E. Scarborough, Jr., and substituted a 90-day drug treatment program.  Mr. Scarborough, who was found guilty of committing 29 burglaries, including many in the east Dupont neighborhood.  Those present expressed their outrange at the Judge's decision.  The Commission voted unanimously to send a letter to Judge Winfield requesting that she reconsider the sentence and take the victim impact into consideration.

GENERAL AGENDA

-- ANC 2B considered a resolution supporting legislation before the DC Council to close a loophole in the tenant right to purchase laws which allows the partial purchase of property by a potential developer through multiple transactions to avoid legal provisions which allow tenants to attempt to purchase the property themselves.  After discussion and some amendments to the resolution, it was adopted by ANC 2B.

-- Representatives of the DC Water and Sewer Authority (DC WASA) provided an update on a 30-day study of select areas in the Dupont Circle neighborhood which has been conducted to determine the cause of storm-related flooding both this year and as far back as August 2001.  DC WASA noted that they have identified some sewer blockages and other problems that will need to be corrected.  WASA officials will return to the Commission at its January meeting to present its plan to address the persistent problems.  (Various Single Member Districts)

-- At the conclusion of voting by registered voters in Single Member District 2B06, the Commission counted the votes, certified the election, and declared that Myron "Mike" Silverstein the winner of the election to fill the vacancy.  Commissioner-Elect Silverstein was congratulated and all candidates were commended for their interest and civic engagement.

REGULATORY AGENDA

-- The Commission considered an application for a new tavern license at 1716 I Street, NW.  The owner for the establishment, called Eye Bar, was present and addressed questions.  ANC 2B took no action on the application.  (2B06)

-- ANC 2B considered an application for a new restaurant license at 1732 Connecticut Avenue, NW.  The owner of the establishment, called Mourayo, was present and addressed questions.  ANC 2B voted unanimously to support this application.  (2B02)

-- The Commission considered the renewal applications for the following establishments:  Fairfax Deli, Metro Supermarket, Prego Again, 1500 Market, Oasis, Virginia Market, Lloyds Deli, and New Hampshire Market.  The Commission took no action on these ABC Class B (Liquor/Convenience Stores) renewal applications.

-- ANC 2B considered Zoning Commission Case #03-32, an application by Cornell University  for expanded non-residential use at 2148 O Street, NW.  It was noted that the expansion will be used for classroom and office space use in a portion of the building previously used for a health clinic.  After a presentation and discussion, the Commission voted unanimously to support the application.  (2B06)

-- The Commission considered Zoning Commission Text Case #03-33.  This case focuses on proposed overlays for R-5-D and R-5-E zones. These text amendments would allow higher density commercial development in certain residential areas.  The Commission voted to request that the Zoning Commission exclude R-5-D and R-5-E zones that are in existing or proposed historic districts from possible application of the proposed overlay, as these changes would be inconsistent with the nature of the historic aspects of these areas.

ADMINISTRATIVE AGENDA

-- The Commission authorized the Treasurer to respond to the DC Auditor's letter of October 23, 2003, pertaining to the ANC's audit.  ANC 2B also approved the minutes of recent meetings and heard an update on progress to resolve sanitation at trash issues at 16th and U Streets, NW.

DECEMBER MEETING
